Terms of Service

These Terms of Service (“Terms”) govern the use of the website “e-stay” (https://e-stay.jp) and the travel arrangement service “Travel Service Kiosk,” both operated by TSK Holding Co., Ltd. (“we,” “us,” or “the Company”). By accessing the website or using our services, you agree to these Terms.

Article 1 — Definitions

  1. “Website” refers to e-stay (https://e-stay.jp), operated by the Company.
  2. “Service” refers to the travel information and arrangement services provided under the name Travel Service Kiosk.
  3. “Customer” refers to any person who accesses the Website or uses the Service.

Article 2 — Scope of Service

  1. We operate as a registered Type 3 Travel Agency under Japanese law, primarily providing arranged travel services.
  2. The specifics of each travel contract are governed by the Standard Travel Agency Terms and Conditions, the Pre-Contract Disclosure, and the Contract Documents.
  3. Travel information published on the Website is provided for planning reference and is not guaranteed to be accurate or current at all times.

Article 3 — Bookings and Applications

  1. A travel contract is formed when we accept your booking application.
  2. Minors must obtain parental or guardian consent before submitting a booking.
  3. We may decline a booking in the following circumstances:
    • The application contains false information
    • The booking would interfere with our business operations
    • The Customer has previously violated these Terms
    • We otherwise determine that the booking is inappropriate

Article 4 — Pricing and Payment

  1. Travel prices are as stated on each product listing.
  2. Payment methods and deadlines are specified in the contract documents.
  3. If payment is not received by the specified deadline, we may cancel the travel contract.

Article 5 — Changes and Cancellations

  1. Cancellation fees prescribed in the Standard Travel Agency Terms and Conditions apply to any changes or cancellations.
  2. If the safe and smooth operation of a trip becomes impossible due to natural disasters, civil unrest, government orders, or other causes beyond our control, we may cancel the travel contract.

Article 6 — Limitation of Liability

  1. Under an arranged travel contract, we exercise the care of a prudent manager in arranging travel services.
  2. Our liability is limited to damages caused by our breach of the arrangement obligation or tortious act. Unless due to our willful misconduct or gross negligence, our total liability shall not exceed the travel price paid.
  3. We are not liable for damages caused by events beyond our control, including natural disasters, transportation delays or cancellations, and changes made by accommodation providers.
  4. We assume no liability for damages arising from the use of travel information or articles published on the Website.

Article 7 — Intellectual Property

All content on the Website—including text, images, designs, and logos—is the property of the Company or its licensors. No reproduction, redistribution, or modification is permitted without our prior written consent.

Article 8 — Prohibited Conduct

Customers shall not engage in:

  1. Any act that violates applicable laws or public order
  2. Providing false information
  3. Infringing the rights of the Company or any third party
  4. Interfering with the operation of the Website
  5. Unauthorized access or any attempt thereof
  6. Any other conduct we deem inappropriate

Article 9 — Service Modifications and Interruptions

  1. We may modify, suspend, or discontinue the Website or Service without prior notice.
  2. We are not liable for any damage resulting from such changes, except in cases of our willful misconduct or gross negligence.

Article 10 — Governing Law and Jurisdiction

  1. These Terms are governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Okayama District Court as the court of first instance.

Article 11 — Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
